WHEREAS, the Mayor and Council have received expression of fear and concern from North Caldwell citizens over the presence of pit bull terriers in their neighborhood; and
WHEREAS, pit bulls posses the quality of "gameness", a concept described as the propensity to catch and maul an attacked victim unrelentingly until death occurs, or as the continuing tenacity and tendency to attack repeatedly for the purpose of killing; and
WHEREAS, the pit bull breeds' characteristics for aggressiveness and gameness can latent and may appear without warning or provocation; and
WHEREAS, and as result of aforementioned characteristics, the Mayor and the Council have determined that the pit bull breed poses a danger to the health, safety and welfare of the citizens of North Caldwell different in degree and kind from the dangers presented by other breeds of dog;
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough of North Caldwell, County of Essex, State of New Jersey, as follows:

Section 1. That Chapter 38, "Dogs and Cats," shall be amended as follows:

A. The title of Section 38-128 shall be amended to read as follows: Disposal of certain vicious dogs required; keeping or harboring of Pit Bull Terriers prohibited.

B. The first paragraph of Section 38-18 shall be redesigned as Section 38-18A.

C. A new Section 38-18B shall be added to read as follows:
No person shall harbor, keep or maintain within the limits of the Borough of North Caldwell, any dog commonly known as a "pit bull terrier". As used in this ordinance, "pit bull terrier" shall be defined as any American Pit Bull Terrier or Staffordshire Bull Terrier or American Staffordshire Terrier breed of dog, or any mixed breed of dog which contains as an element of its breeding the breed of American Pit Bull Terrier or Staffordshire Bull Terrier or American Staffordshire Terrier as to be identifiable as partially of the breed of American Pit Bull Terrier, Staffordshire Bull Terrier or American Staffordshire Terrier.

SECTION 2. This ordinance shall take effect upon adoption and publication as required by law
