Synopsis As Introduced Amends the Animal Control Act. Removes a restriction that forbids classifying vicious
dogs by breed. Allows municipalities and other political subdivisions to regulate animals
specific to breed (now, they may not regulate specific to breed).

Amends the Animal Control Act. Requires owners of dangerous and vicious dogs to maintain liability insurance for damage, injury, and death caused by the dog.
Requires that a dog's breed be considered in the determination of the dog as dangerous
or vicious if the dog is of a breed presumed to be
a dangerous or vicious breed. Authorizes municipalities and other political
subdivisions to ban those breeds and to regulate dogs by breed.
Changes the physical requirements for keeping dangerous and vicious dogs. Beginning January 1, 2007,creates, and changes the penalties for existing, offenses with respect to dangerous and vicious dogs. Effective immediately.

4219 Short Description: DOG ATTACK-FELONY Rep. Mike Boland

Synopsis
As Introduced Amends the Animal Control Act. Provides that if any dog (now, certain vicious dogs),
(1) inflicts serious physical injury upon any person other than the owner or causes the death of another person; and
(2) the attack is unprovoked in a place where such person is peaceably
conducting himself or herself and where such person may lawfully be;
the owner of the dog is absolutely liable and shall be guilty of a Class 4 felony,
unless the owner knowingly allowed the dog to run at large or failed
to take steps to keep the dog in an enclosure, then the owner shall be guilty
of a Class 3 felony. Provides that if any dog (now, certain dangerous dogs) inflicts
serious physical injury on a companion animal the owner of the dog shall be
guilty of a Class A misdemeanor.

4238 Short Description: ANIMAL CONTROL-DOG AT LARGE

Amends the Animal Control Act. Provides that the owner of an intact dog is guilty of a Class 4 felony if the owner allows the dog to run at large in violation of the Act and the dog inflicts
serious physical injury to a person.

The amendment has been made, deleting the $ 50.00 penalty maximum and here is the best part !!!
(D) has been re-written to:
(d) If the owner of a dog knowingly allows it to run at 15 large in
violation of this Act as specified in Section 9 and 16 the dog inflicts serious physical injury,
as defined in this 17 Act, or death to a person, the owner is guilty of a Class 4
18 felony. This subsection does not apply to a police dog that
19 inflicts physical or serious physical injury to a person in the 20
course of its duties.

The bill has picked up five co-sponsors, so it is getting the needed support
Brief description... Amends the Criminal Code of 1961 relating to dog fighting. Increases the penalty for attending a dog fight from a Class C to a Class A misdemeanor.
Provides that if a person under 13 years of age is present at any dog fight,
the parent, legal guardian, or other person who is 18 years of age or older who brings that person
under 13 years of age to that dog fight is guilty of a Class 4 felony for a first violation
and a Class 3 felony for a second or subsequent violation.

HB-4761-BAD BILL OPPOSE A New Bill introduced today(1-18-06), a sneaker through the back door this is normal as we are all watching HB-4212-13 he sneaks this one in.
He was involved with HB-4212 +HB-4213 and still is.

Brief description...
Authorizes the finder of fact to consider the breed of the dog in any
determination as to whether an individual dog is vicious.
However, if the animal control warden has found the dog to be vicious under
subsection (a) of this Section, then there shall be a mandatory presumption
that the dog is vicious.
